Stephen J. Murphy has been one of New York’s top plaintiff-side personal injury trial attorneys for more than two decades. As a managing partner at Block O’Toole & Murphy, Mr. Murphy handles a wide array of personal injury cases, including serious construction accidents, motor vehicle and pedestrian accidents, premises liability issues, and wrongful death incidents.

Mr. Murphy’s skill and hard work in the courtroom have earned him many accolades from fellow attorneys, opponents, and judges. He was named the 2022 “New York City Lawyer of the Year” for all Plaintiff Personal Injury Lawyers by Best Lawyers®, and, since 2023, Forbes Magazine has recognized him as one of New York City’s Best Personal Injury Lawyers. He has also been named a “New York Super Lawyer” since 2010, which honors him as one of the top 5% of lawyers in the NYC Metro Area.

Described by The New York Times as one of the “top attorneys in New York,” Mr. Murphy is an expert on both civil and criminal legal issues, and he regularly appears in local and national news as an expert commentator. Z100 Radio has referred to him as a “legendary trial lawyer,” and Fox News Radio has previously called him one of “America’s premier trial lawyers.” Mr. Murphy also formerly served as an Adjunct Professor of Law with St. John’s University School of Law, where he taught students the art of trial law.

Mr. Murphy draws on his experiences as a former homicide prosecutor to inform his current work on catastrophic personal injury trial work. After graduating from St. John’s University School of Law, Mr. Murphy honed his skills prosecuting violent crimes as an Assistant District Attorney in Brooklyn. He was eventually appointed to Brooklyn’s Homicide Bureau, becoming the youngest member of the team at the time. There, he handled several high-profile cases, including double and triple murders, arson homicides, and gang murders.

In 2005, Mr. Murphy made the switch from criminal to civil law, joining what is now Block O’Toole & Murphy as a tenacious and respected trial lawyer. Since then, he has obtained some of New York’s most significant landmark results. He has amassed over $500,000,000 in results for his clients and consistently returns verdicts and settlements in excess of $1,000,000. Members of the bar from Brooklyn to Buffalo frequently consult with Mr. Murphy on trial matters and refer their most significant cases to him.

 

Seminal Personal Injury Case Results

Mr. Murphy has handled the following significant cases:

  • $32,756,156 jury verdict for a 60-year-old pedestrian in a Suffolk County traumatic brain injury case. The verdict, which was featured in a cable television documentary titled “The Good Samaritan,” is the largest negligence verdict in Long Island. It was also recognized by the New York Law Journal as the second highest negligence verdict in New York State for the year.
  • $15,500,000 settlement for a client who sustained a traumatic brain injury in a pedestrian knockdown case.
  • $9,950,000 settlement in a Buffalo case for a young social worker who lost her leg after she was struck by a vehicle in a parking lot. Mr. Murphy and Partner David L. Scher were able to persuade two insurance carriers to settle, narrowly avoiding trial.
  • $9,689,320 settlement for the children of a homicide victim in a highly publicized murder case.
  • $9,500,000 settlement for a 60-year-old painter who fell from a ladder and sustained traumatic brain injuries while working at an airport hangar in Westchester County.
  • $9,500,000 settlement for a pedestrian who was crossing the street in Brooklyn when he was hit by an NYCTA bus. The bus knocked our client to the ground and dragged him down the road, causing severe orthopedic injuries that required an amputation of his right leg.
  • $8,800,000 settlement for a 53-year-old woman who was struck by a vehicle while walking along a sidewalk in Queens. She suffered a traumatic brain injury, along with nerve damage, broken ribs, and other orthopedic injuries. In 2014, this result was the tenth largest settlement in the entire United States.

Over the past decade, Mr. Murphy has regularly obtained some of New York’s top settlements, particularly in construction accident cases. His commitment to the hardworking men and women of New York shows up in his results:

  • In 2021, Mr. Murphy was recognized by VerdictSearch for returning the top three construction accident results in the entire Northeast for the year.
  • In 2020, Mr. Murphy and Partner David Scher obtained three of VerdictSearch’s Top 50 Personal Injury Settlements in the United States – the only two attorneys in the country to do so. The three settlements were a $4,500,000 settlement for a workplace fall, a $4,450,000 settlement for a forklift accident, and a $3,600,000 settlement for a scaffold fall.
  • In 2016, Mr. Murphy was the lead trial lawyer on the second ($9,975,000), third ($7,400,000), and fifth ($5,500,000) largest settlements in New York. That year, he reported more million-dollar results than any other attorney in the state.
  • In 2015, Mr. Murphy was the lead attorney on three of New York Law Journal’s top 25 settlements for the year. This included a $7,525,000 settlement (#5), a $4,600,000 settlement (#13), and a $3,200,000 settlement (#25).

 

Positions Held

Committed to protecting the rights of New York’s construction workers, Mr. Murphy has been part of the New York State Trial Lawyers Association’s (NYSTLA’s) Labor Law Committee since 2012. He also previously served on the NYSTLA Board of Directors and as a Co-Chairman for the organization’s Partnership for Justice.

Mr. Murphy served as an Adjunct Professor of Law with St. John’s University School of Law from 2003 to 2011. There, he taught students the art of trial advocacy, lecturing them on both criminal and civil trial practices. He was also an instructor for the school’s nationally recognized trial advocacy program. In his seven years of this role, Mr. Murphy’s students won national trial competition championships five times.

Charity Work

Mr. Murphy is a longtime member of St. Jude Children’s Hospital fundraising team. Together with partners Jeffrey Block, Daniel O’Toole, and David Scher, Mr. Murphy has raised over $10,000,000 for the hospital at the firm’s annual New York City Wine Tasting event. In 2019, he received the St. Jude’s “Chairperson of the Year” award for his dedication to ending pediatric cancer. In 2014, St. Jude named him as “Volunteer of the Quarter” for his efforts.

In keeping with these efforts to support pediatric cancer patients, Mr. Murphy also supports the Frances Pope Memorial Foundation. This volunteer-run organization helps families as they care for a child with cancer. In 2010, Mr. Murphy received the foundation’s “Man of the Year” award.

Mr. Murphy is a supporter of the Brooklyn to Alaska Project, which sends Brooklyn teens to the Alaskan wilderness to build connections with the outdoors and each other. In 2017, he was honored by the organization for his work.
