$1,250,000 Settlement for Driver Injured in Old Brookville Car Crash

Plaintiff Description
Our client was a 40-year-old father of five who worked as a home health aide.   

Description of Case
When our client paused for traffic on Glen Cove Road in Old Brookville, his vehicle was struck in the rear by another car that failed to stop. The impact caused our client’s car to lurch forward into the car in front of him. He was rushed to the emergency room and later found to have herniated discs in his neck and back. Months of physical therapy and injections would prove insufficient to alleviate his injuries, so he had to undergo spinal fusion surgery.  

The defendant tried to argue that our client, at just 40 years of age, had degenerative spinal damage from everyday activities. Our attorneys fought aggressively for our client to refute these claims and hold the defendant accountable for the negligence that caused our client’s pain and suffering. 

Injuries/Damages
After the accident, EMS arrived on the scene and our client was rushed to the hospital by ambulance. After treatment and discharge, our client still suffered neck and lower back pain. An MRI revealed disc herniation at the L4-L5 and L5-S1 levels, as well as a herniation at the C5/6 segment impressing the ventral cord margin. After attempting injections and physical therapy 2-3 times a week, our client still experienced pain from his injuries. Once COVID-19 hit, our client had to do his best to continue physical therapy at home. 

Further study revealed cervical radiculopathy, and our client’s doctor recommended spinal fusion surgery to improve our client’s quality of life. Our client underwent cervical spine fusion surgery at the C5/6 segment.

The case settled for $1,250,000.
