$1,800,000 Settlement for Passenger Injured in Crash Caused by Negligent Driving
In a New York vehicle accident case, our client was injured as a result of negligent driving. She was a passenger in a vehicle that stopped abruptly on FDR drive in moving traffic and was rear-ended by another vehicle that was following too closely. FACTS AND ALLEGATIONS
This matter stems from a motor vehicle accident which occurred on August 16, 2012, at 1:15 pm on the Northbound FDR at or about the East 105th Street exit, New York, New York. The client, a passenger in a vehicle owned and operated by defendants #1, was caused to be injured when the vehicle in front of them owned and operated by defendants #2, stopped short when the driver struck the gear shift out of drive with his arm causing the vehicle to abruptly stop causing the GVC II vehicle to strike them in the rear. Our client claimed all defendants were negligent for stopping abruptly in a moving lane of traffic and in following too closely causing them to strike the other vehicle in the rear.
The client sustained bilateral knee meniscal tears requiring arthroscopic surgeries as well as a right shoulder tear requiring arthroscopic repair as well as lumbar herniations at L4-L5 and L5-S1 segments requiring a fusion at those levels.
The client had no lost earnings claim, but made claims for past and future medical expenses, as well as pain and suffering and loss of enjoyment of life.
The parties negotiated a $1,800,000 pretrial settlement.
