$1,400,000 Settlement For 69 Year-Old Asbestos Worker From Rochester Who Was Injured In A Scaffold Accident

Sustained Leg And Back Injuries

A 69 year old asbestos handler fell from a scaffold while performing asbestos removal at a High School in Rochester New York. He suffered injuries to his left leg and low back. The scaffold did not have guardrails, violating long standing worker safety laws. As he was removing asbestos from pipes in the ceiling the scaffold shifted causing him to fall to the ground.

Partners S. Joseph Donahue and Jeffrey A. Block successfully argued that the owner and general contractor were responsible for the accident in that they violated Labor Law 240(1) and 241(6) by failing to provide the client with a scaffold with guardrails and that the failure to do so resulted in the client falling from the scaffold to the ground below.

As a result of the accident, our client suffered a left leg fracture that required two surgeries and a worsening of his degenerative spine condition, necessitating surgery.
