Plaintiff was 54 years old and was already disabled from employment at the time of the accident.

DESCRIPTION OF CASE
The Plaintiff was a woman with a 30 year history of medical treatment for neck and back problems, as well as other disabling conditions. On the date of the incident, Plaintiff was operating her vehicle on the Long Island Expressway when she was struck in the rear by the Defendant’s car. Plaintiff’s vehicle suffered very little damage. Plaintiff refused medical attention and drove her vehicle away from the scene.

INJURIES/DAMAGES
Plaintiff eventually began treating with doctors and complaining of a worsening of her pre-existing neck and back pain. She ultimately underwent a neck and a low back surgery. Plaintiff alleged that as a result of the worsening of her injuries, she suffered increased pain and limitations, and would require ongoing medical treatment for the remainder of her life. Defendants argued that Plaintiff’s neck and back problems were not caused by the accident, and that the surgeries had alleviated much of her pain.
