The Plaintiff was 48 at the time of the accident and was 53 years of age at the time the case resolved. He was employed by North General Hospital as an orderly in the psychiatric ward.

DESCRIPTION OF CASE
The case stemmed from a motor vehicle collision that occurred at Rockaway Blvd. and Guy R. Brewer Blvd. in Jamaica, Queens. The Plaintiff was working in an ambulance, transporting a patient in a non-emergency setting. The vehicle plaintiff was in proceeded through a green light at the subject intersection as did a left turning vehicle being driven by defendant Johnson and owned by the defendant Horak. The impact was substantial. The defendants each claimed that the other was the cause of the accident. The plaintiff ultimately underwent a cervical discectomy with a plate at C3-C4. Following that surgery there was a further opinion that the Plaintiff required an additional fusion at an adjacent level. That surgery was not performed secondary to a life threatening (non accident related) heart ailment that made additional surgery impossible. It was undisputed that the Plaintiff’s heart condition was life threatening and could result in sudden death at any time.
