$5,160,000 for Landscaper With Spine Injuries From a Car Crash

Block O'Toole & Murphy trial attorneys S. Joseph Donahue and Jeffrey A. Block persuaded a Queens County, New York jury to award a 38-year-old landscaper in excess of $5,100,000 for neck, back and shoulder injuries sustained in an October 2011 collision.

The accident occurred at a Queens intersection when the Defendant ran through a stop sign and collided with the passenger side of Plaintiff's vehicle. Defendant conceded liability and the matter proceeded to a damages only trial to determine the amount of the award.

Plaintiff suffered injuries to his neck, back and shoulder requiring three surgeries. At trial, Defendant argued that Plaintiff's condition existed prior to the accident and that the surgeries were unrelated to the accident.

The jury disagreed, finding Plaintiff's injuries were caused by the accident, and awarded Plaintiff $5,160,000.00 in damages. The jury verdict came after five weeks of trial and nearly three days of jury deliberations.
