Car Accident - Statute of Limitations in New York State

Under New York State law, you can apply for No-Fault benefits of up to $50,000 in damages through your auto policy. If you were not hurt in the crash and the financial recovery is for property damage only, you may not need legal representation in this case. However, there is a very limited and short time period to recover No-Fault insurance coverage (typically within 30 days). If you are seeking No-Fault benefits for property damage only, it's crucial you begin the process as soon as possible.

If you were injured in the car crash because of wrongful conduct by another party, you may be able to file a personal injury lawsuit against the responsible party to help you recover additional compensation for medical bills, lost wages, pain and suffering, and more.

According to New York State Law N.Y. C.P.L.R. § 214(4), the time limit to file a personal injury lawsuit after a car crash is 3 years after the accident. However, this law is subject to exceptions. If you were hurt in a car accident, it's best to speak with an injury attorney with a strong knowledge of car accident and injury laws immediately or soon after the crash. This will help the attorney collect evidence and other insights to better help you with the case.

Liability in Car Crashes

In order to prove liability in a car crash injury lawsuit, the lawyer who takes your case must prove that the other party was negligent and that their mistake(s) resulted in your injuries. For instance, if you had the right of way and another driver failed to yield, they are likely responsible for the crash. In another instance, if icy roads caused two vehicles to spin out of control and crash into each other, there may be a case against the state or city municipality in charge of maintaining the roads.

Common causes of accidents where the other party may be at fault include:

  • Drunk Driving
  • Distracted Driving (e.g. texting or other cell phone use)
  • Failure to Yield
  • Road Hazards and Road Defects (e.g. debris, icy roads, signage not visible to drivers, etc.)
  • Manufacturer Automobile Defects

Police reports help provide evidence of the circumstances of the accident. Our legal team also works with traffic experts, witness accounts, and more to recreate the accident scene.

Severe Injuries from Car Collisions

Each year in New York State, over 9,000 people are seriously hurt as a result of an auto collision. Under Section 5102(d) of the New York Insurance Law, serious injuries are personal injuries which result in death, loss of body organs, members, functions, or systems, loss of fetus, significant disfigurement, fractures, and other injuries that prevent a person from performing substantially his or her everyday activities for 90 days or more during the 180 days immediately following the injury.

Common severe injuries from car crashes include but are not limited to the following:

  • Death
  • Amputation
  • Paralysis and other Spinal Injuries
  • Coma
  • Brain Damage such as Traumatic Brain Injury (TBI)
  • Blindness
  • Burns
  • Heart Attacks
  • Significant Scarring
  • Multiple Fractures

Sometimes, car accident victims may experience delayed symptoms. For example, concussions may not be apparent immediately after a crash. When the car stops immediately, the impact of sudden motion to the brain can be quite dangerous. Emotional trauma such as PTSD can also be a delayed symptom of a car collision.
