Fatal Construction Accident Case Concludes with $4,475,000 Settlement

Block, O Toole & Murphy is pleased to announce that it has obtained a $4,475,000 settlement in a lawsuit filed after a fatal construction accident. In December 2007, a 33 year-old union ironworker foreman was working at a construction site in New York City when the flooring he was on collapsed, causing him to fall ten stories. He later passed away as a result of his injuries. The substantial settlement was awarded to the two children the victim left behind, aged 1 and 3 at the time of the accident. We commend the hard work put into this case by attorneys Daniel P. O'Toole and Frederick C. Aranki.

The victim was working as a foreman on a construction site at 113 Bank Street in New York City where he was participating in a complete gut renovation for a subcontractor. As he was walking on the site, temporary flooring upon which he was walking collapsed, causing him to fall approximately 10 feet to the floor below. He was brought to the hospital but later died of his injuries.

The decedent's estate made a claim for the conscious pain and suffering from the time of the victim s injury to the time of his death. In addition, his estate made a claim for the value of what the deceased would have earned in salary and benefits were it not for his death. The deceased s children made claims for the loss of parental guidance and support due to their father's death. The settlement will be paid out in the form of a structured annuity which will pay the children monthly payments that amount to approximately $22,000,000 over the course of their lives.

Workplace and especially construction accidents can be very serious, leading to debilitating injuries or death that could jeopardize long-term financial stability for the victim and his or her family. Financial compensation can never make up for significant injuries sustained or replace the life of a loved one, but it can reduce the financial pressures that often arise after a catastrophic accident. If you are injured in an accident, contact a New York construction accident attorney today to receive a free case evaluation to see if you might be eligible to receive monetary remuneration for your lost wages, medical bills, and pain and suffering.
