“Scaffold tipped over; causing Plaintiff To fall approximately 25 feet to the stone folder.”

INJURIES/DAMAGES
“Herniated discs at L4-5 AND L5-S1; multiple tears of the menisci of the right knee; Grade III chondromalacia. Plaintiff sustained tears to the left meniscus 7 years after the accident due to compensatory mechanism syndrome. He underwent a right knee arthroscopy, meniscectomy, and chondroplasty. He also underwent a percutaneous laser disc compression (PLDD) at L4-5, but his surgeon was unable to perform the procedure at L5-S1 because he could not gain entry into that disc space due to Pltfs high iliac crest. Plaintiff then underwent a bilateral decompressive laminotomy facetectomy at L4-5 and L5-S1.”

NOTE
This is the first case reported in The New York Jury Verdict Reporter in which a 3-D video of a back surgery was shown to the jury. This was a microscopic surgery, filmed through the left and right eye pieces of the operating microscope. A computer was used at trial that performed the same function as the human brain in alternating left and right eye images so they can be visualized three-dimensionally. This case was handled by Jeffrey A. Block & Daniel P. O’Toole.
