DESCRIPTION OF CASE
Plaintiff, a building superintendent, was standing beneath a spider scaffold outside his place of employment. Plaintiff was identifying the area of a leak for a construction foreman when he was struck in the face by a brick that had fallen of a scaffold nine or 10 stories above him.
"Bulging disc, lumbar; dental; emotional distress; facial fractures; fracture, mandible; fracture, nose; fracture, orbit; fracture zygomatic arch; herniated disc at C5-C6, loss of consortium, scar and/or disfigurement."
