DESCRIPTION OF CASE

On May 23, 2012, the Plaintiff was a refereeing a basketball game in Central Park when he was struck by a utility cart being driven by a New York City Parks Department employee in the course of her employment. The Plaintiff was granted summary judgment by the Court on the issue of liability.

DAMAGES

The Plaintiff suffered an exacerbation of cervical spine injuries as a result of the accident for which he initially conservatively treated and eventually required a cervical fusion surgery. The Plaintiff alleged damages for past and future pain and suffering and economic damages for past and future lost wages and medical expenses.

SETTLEMENT

The case was settled for $3,400,000.
