DESCRIPTION OF CASE
Plaintiff was operating his Harley Davidson motorcycle southbound on 7th Avenue while wearing a toy helmet when the Defendants traveling northbound on 7th Avenue made a left turn at or near the intersection with Prospect Avenue causing the accident.

INJURIES/DAMAGES
Plaintiff sustained a fractures skull and multiple hematomas causing him to undergo a craniotomy/craniectomy and causing permanent cognitive disorder. The Hospital records state that Plaintiff was not wearing a helmet at the time of the accident. Plaintiff was not wearing a helmet at the time of the accident. Plaintiff had retrograde amnesia and could not testify to his wearing a helmet.
