Bronx Tenant Fell Down Stairs in Apartment Building, Causing Neck and Shoulder Injuries

Plaintiff was 58 years old on the date of the accident. Plaintiff was self-employed selling homemade Tamales.

FACTS AND ALLEGATIONS

Plaintiff, a tenant in defendant's residential apartment building, was injured when she was caused to slip and fall down stairs within her building. Plaintiff alleged there was a longstanding water leak condition from the roof that had been replaced and repaired by defendant roofing company that was causing water to penetrate the inside of the building including on the subject stairs.

INJURIES/DAMAGES

Plaintiff sustained cervical herniations requiring fusion surgery at the C5-C6 segment. Plaintiff also sustained tears to the right shoulder requiring arthroscopic surgeries.

Plaintiff made claims for past and future medical expenses as well as pain and suffering and loss of enjoyment of life.

RESULT

The parties negotiated a $2,250,000 pretrial settlement.
