DESCRIPTION OF CASE
Plaintiff was a rear seat passenger in a car that was struck in the rear by the Defendant van. Plaintiff was granted summary judgment on the issue of liability.

INJURIES/DAMAGES
Plaintiff suffered injuries to his left shoulder, left knee and lower back. He underwent surgeries to all three body parts. His low back surgery involved a discectomy with fusion involving plates and screws. Plaintiff had no lost earnings claim, but did claim damages for related medical expenses, pain and suffering and loss of enjoyment of life.

The defense argued that Plaintiff's injuries pre-dated the accident.
