On November, 24, 2008, the Plaintiff, a 62 year-old livery cab driver, was injured in a motor vehicle accident on Broadway at the intersection of 133rd Street in New York, New York, when he was rear-ended by the defendant's delivery truck. The plaintiff was granted summary judgment on the issue of liability.
The plaintiff sustained a serious neck injury, including multiple herniated discs. After conservative treatment failed, he eventually underwent surgery to his neck which included the insertion of hardware into his cervical spine. The plaintiff also alleged damages for future medical treatment and costs.
Result: The case settled on October 7, 2011, for $1,500,000.
